Decision of the Arbitration Court of the Krasnodar Territory on the recognition of illegal actions, invalid letter dated 13.03.09 No. 03-1-17/ 502

The Southern Transport Prosecutor's Office, Krasnodar appealed to the arbitration court with an application to recognize as illegal the actions of the Office of the Federal Service for Veterinary and Fiscal Surveillance for the Krasnodar Territory and the Republic of Adygea on the publication of a letter dated 13.03.09 No. 03-1-17 / 502 and the vocation invalidation of the letter of the Rosselkhoznadzor Administration for the Krasnodar Territory and the Republic of Adygea dated 13.03.09, No. 03-1-17 / 502 "On the organization of work on the decontamination of subcarantia objects by the method of gassing and work on their degassing". The prosecutor's office insists on satisfying the stated requirements, considers that the impugned letter is a non-normative act. The prosecutor's office explained in the court hearing that Fumigard Company LLC was involved in the case as an interested person mistakenly, which is reflected in the record of the court hearing dated 23.07.09.
