Resolution No. 09AP-19669/2011-AK Moscow of 05.09.2011

The Federal Service for Veterinary and Phytosanitary Surveillance (hereinafter referred to as the applicant, Rosselkhoznadzor) applied to the Arbitration Court of Moscow with an application to declare illegal the decision and order of the Federal Antimonopoly Service (hereinafter referred to as the defendant, the antimonopoly authority, the FAS of Russia) dated 02.02.2011 in case No. 15/189-10 on the applicant's violation of antimonopoly legislation.

By the decision of 14.06.2011 the Arbitration Court of Moscow satisfied the stated requirements, motivating its conclusions by the fact that the contested decision and the order of the FAS of Russia do not comply with the provisions of the Federal Law of 26.07.2006 No. 135-FZ "On Protection of Competition".
