Decision of the Arbitration Court of Appeal of Rostov-on-Don on 14.03.2005

On the recognition of the illegal actions of the Rostov Branch of the Federal State Enterprise "Rosgoskarantin", it was established: the limited liability company "Fumigrain" (hereinafter referred to as the company) appealed to the arbitration court with an application to recognize as illegal the actions of the Federal State Institution "State Inspectorate for Plant Quarantine of the Russian Federation (FGU "Rosgos Quarantine") represented by the Rostov branch (hereinafter referred to as the inspection).

The company's statement is motivated by the fact that the actions of the inspection persons prevent the company from fumidying the grain exported from the Russian Federation and force the shipper-exporter of Alfa-Eco-Don LLC to apply only to the services of the Federal State Unitary Enterprise "Republican Fumigation Squad" when decontaminating grain by gasification to obtain a phytosanitary certificate.
